A switch from Florida’s current personal injury protection auto insurance to a requirement that motorists have bodily injury liability insurance would protect people better while lowering costs, writes attorney Richard D. Schuler.

When most people think about driving, they focus on the freedom it provides — not the responsibilities that come with it. But the reality is, accidents happen. When they do, victims deserve fair compensation for their injuries, and those responsible should be held accountable. That’s why Florida must implement mandatory bodily injury (BI) liability insurance.
Right now, Florida is one of only three states that does not require drivers to carry bodily injury liability coverage. Instead, our state mandates only Personal Injury Protection (PIP) insurance, which was originally intended to reduce court congestion by covering minor injuries regardless of fault. However, over time, PIP has become riddled with fraud and abuse, driving up premiums for all Floridians. In fact, Florida suffers under some of the highest auto insurance premiums in the country — despite lacking mandatory BI coverage.
